IMPORTANT NOTICE

JoyRide is committed to providing a marketplace where Hosts and Guests can participate in vehicle sharing in a manner that is safe, lawful, respectful, and reliable.

This Community, Trust & Safety Policy ("Safety Policy") establishes JoyRide's rules and procedures concerning:

  • Safety reports;
  • Trip incidents;
  • No-shows;
  • Unsafe or unfit vehicles;
  • Guest and Host misconduct;
  • Fraud;
  • Unauthorized use;
  • Harassment;
  • Threats;
  • Dangerous driving;
  • Damage;
  • Vehicle abandonment;
  • Account restrictions;
  • Suspensions;
  • Permanent bans;
  • Investigations; and
  • Other trust-and-safety concerns.

This Safety Policy supplements the JoyRide Terms of Service, JoyRide Host Agreement, JoyRide Privacy Policy, and applicable JoyRide Trip Protection and Platform Protection Terms.

Nothing in this Safety Policy limits any right, remedy, protection, or obligation that cannot lawfully be waived.

1. OUR SAFETY PRINCIPLES

JoyRide's trust-and-safety program is based on the following principles:

  1. Safety first.
  2. Accurate information.
  3. Respectful conduct.
  4. Lawful use of vehicles.
  5. Prompt reporting of serious incidents.
  6. Fair investigation of reported incidents.
  7. Protection against fraud and abuse.
  8. Appropriate action when safety rules are violated.
  9. Protection of personal information.
  10. Compliance with applicable law.

JoyRide may take action when conduct creates a meaningful risk to Guests, Hosts, third parties, vehicles, the Platform, or the broader community.

2. SCOPE

This Safety Policy applies to:

  • Guests;
  • Hosts;
  • Authorized additional drivers;
  • Vehicle owners;
  • Persons using the Platform;
  • Persons communicating through JoyRide;
  • Persons participating in a Booking; and
  • Other persons whose conduct materially affects the JoyRide marketplace.

3. EMERGENCIES

JoyRide is not a substitute for emergency services.

If there is an immediate threat to life, serious injury, fire, active crime, or another emergency, contact the appropriate emergency service first.

Depending on location, this may include 911 or the applicable emergency number.

After addressing the immediate emergency, the person involved should notify JoyRide through the appropriate support or incident-reporting channel when reasonably safe to do so.

4. SERIOUS SAFETY INCIDENTS

A Serious Safety Incident may include:

  • Collision involving significant injury;
  • Suspected impaired driving;
  • Vehicle fire;

A Guest or Host may report a safety concern through:

  • JoyRide's in-app reporting tools;

  • Vehicle records; and
  • Other information reasonably necessary to evaluate the report.

6. WHEN TO REPORT

Users should report safety concerns as soon as reasonably possible.

Certain incidents may have specific reporting deadlines under the applicable Terms, Protection Terms, insurance policy, or law.

Delay in reporting may make an incident more difficult to investigate.

7. TYPES OF REPORTABLE INCIDENTS

Examples of reportable incidents include:

  • Unsafe brakes;
  • Unsafe tires;
  • Steering problems;
  • Significant mechanical failure;
  • Dangerous warning lights;

  • Off-platform payment requests.

8. HOST DUTY TO REPORT AN UNFIT VEHICLE

A Host must not knowingly make an unsafe or materially unfit vehicle available to a Guest.

If a Host discovers that a vehicle is unsafe before a Booking, the Host must:

  1. Stop offering the vehicle;
  2. Remove or block its availability;
  3. Notify JoyRide when appropriate; and
  4. Address the safety issue before making the vehicle available again.

9. GUEST DUTY TO REPORT AN UNFIT VEHICLE

A Guest should not operate a vehicle that the Guest reasonably believes presents an immediate safety risk.

Examples may include:

  • Brake failure;
  • Steering failure;
  • Tire failure;
  • Serious overheating;
  • Significant fluid leak;
  • Fire or smoke;
  • Severe warning indicators;
  • Dangerous windshield damage; or
  • Other material safety defects.

Where reasonably safe, the Guest should stop operating the vehicle and contact JoyRide.

10. UNFIT VEHICLE STANDARD

A vehicle may be considered Unfit when JoyRide reasonably determines that its condition creates a material safety or legal concern.

Factors may include:

  • Mechanical condition;
  • Tire condition;
  • Brake condition;
  • Safety-system condition;
  • Required registration;
  • Inspection status;
  • Recall status;
  • Vehicle damage;
  • Insurance status;
  • Vehicle age;
  • Title status;
  • Missing required equipment; and
  • Applicable law.

11. JOYRIDE VEHICLE SUSPENSION

JoyRide may immediately suspend a vehicle when there is credible information suggesting that the vehicle may be unsafe, unlawful, materially misrepresented, or otherwise unsuitable for continued marketplace use.

Suspension may remain in effect while JoyRide:

  • Investigates;
  • Requests documentation;
  • Obtains inspection;
  • Reviews insurance;
  • Reviews repair records;
  • Communicates with the Host;
  • Communicates with a Guest; or
  • Takes other reasonable safety measures.

12. VEHICLE REINSPECTION

JoyRide may require an inspection before restoring a suspended vehicle.

The inspection may be performed by:

  • JoyRide;
  • A qualified third-party inspector;
  • A repair facility;
  • An authorized mechanic; or
  • Another qualified provider.

The Host may be responsible for inspection or repair costs where provided by applicable JoyRide policies or agreements.

13. FALSE SAFETY REPORTS

JoyRide takes safety reports seriously.

Knowingly submitting a materially false safety report may constitute a violation of this Safety Policy.

Examples include falsely claiming:

  • Vehicle damage;
  • Unsafe vehicle conditions;
  • Theft;
  • Harassment;
  • Criminal conduct;
  • Fraud;
  • Injury; or
  • Other misconduct.

Good-faith reports will not be penalized merely because JoyRide ultimately determines that the allegation could not be substantiated.

14. GOOD-FAITH REPORTING

JoyRide encourages users to report genuine concerns even when they are uncertain about the ultimate cause of an incident.

A person does not need to prove a violation before making a good-faith report.

JoyRide may investigate the report and determine the appropriate response.

15. NO-SHOWS

A No-Show occurs when a Guest or Host fails to appear or otherwise fails to complete a required Booking handoff without properly cancelling or communicating through JoyRide.

JoyRide may establish specific no-show procedures for particular Booking types.

16. GUEST NO-SHOW

If a Guest does not appear for a Booking:

  1. The Host should follow JoyRide's check-in procedures;
  2. The Host should not independently cancel the Booking unless instructed or authorized;
  3. The Host should document the circumstances when appropriate;
  4. The Host should report the no-show through JoyRide; and
  5. JoyRide will determine the applicable cancellation, refund, and payout consequences.

A Guest may be charged a no-show fee where permitted by the applicable cancellation policy.

17. HOST NO-SHOW

If a Host fails to provide the vehicle as required:

  1. The Guest should contact JoyRide;
  2. The Guest should not engage in confrontation;
  3. The Guest should document the situation where safe;
  4. JoyRide may cancel the Booking; and
  5. JoyRide may provide a refund or other remedy under the applicable policy.

Repeated Host no-shows may result in suspension or removal from the marketplace.

18. VEHICLE UNAVAILABLE AT PICKUP

If the vehicle is unavailable at the scheduled pickup time, JoyRide may treat the incident as a Host fulfillment failure depending on the circumstances.

Examples include:

  • Host failed to make the vehicle available;
  • Vehicle was rented elsewhere;
  • Vehicle was unavailable due to undisclosed mechanical problems;
  • Host provided the wrong location;
  • Host provided an inaccessible vehicle;
  • Vehicle was missing; or
  • Vehicle materially differed from the Listing.

19. MATERIALLY MISREPRESENTED VEHICLE

A vehicle may be considered materially misrepresented if its actual condition or characteristics substantially differ from its Listing.

  • Undisclosed major damage;
  • Significantly different vehicle condition;

JoyRide prohibits use of Host Vehicles while impaired by:

  • Alcohol;
  • Illegal drugs;
  • Misused prescription medication;
  • Other substances that materially impair safe driving.

JoyRide may suspend or terminate an account following credible reports or evidence of impaired driving.

22. UNAUTHORIZED DRIVERS

Only authorized drivers may operate a Host Vehicle.

JoyRide may work with payment processors and financial institutions where appropriate.

31. IDENTITY VERIFICATION

JoyRide requires identity verification before a person can:

  • Host a vehicle;
  • Complete a booking as a Guest; or
  • Receive a Host payout.

JoyRide may also require identity verification to continue using the Platform or complete certain other transactions.

Verification may include information such as:

  • Government-issued identification;
  • Selfie or facial comparison;
  • Name;
  • Date of birth;
  • Address;
  • Driver's license information; and
  • Other information necessary for identity verification.

Identity verification may be provided by a third-party provider.

32. DRIVING RECORD CHECKS

JoyRide may conduct driving-record or motor-vehicle-record checks where permitted by law and required for eligibility.

A Guest may be denied or restricted from driving based on applicable eligibility standards.

JoyRide will handle such information according to applicable law and its Privacy Policy.

33. ACCOUNT SHARING

Users may not knowingly allow another person to use their JoyRide account to circumvent:

  • Identity verification;
  • Driver eligibility;
  • Payment restrictions;
  • Account suspension;
  • Safety restrictions; or
  • Other Platform requirements.

34. BAN EVASION

A person whose account has been suspended or terminated may not create another account to circumvent the restriction.

JoyRide may take action against accounts reasonably believed to be created for ban evasion.

35. MULTIPLE ACCOUNTS

JoyRide may restrict users from maintaining multiple accounts where multiple accounts are being used to:

  • Evade restrictions;
  • Manipulate reviews;
  • Commit fraud;
  • Circumvent fees;
  • Abuse promotions; or
  • Otherwise violate JoyRide policies.

36. OFF-PLATFORM CIRCUMVENTION

Users may not use JoyRide to arrange an initial transaction and then move the transaction off-platform for the purpose of avoiding JoyRide fees, safety systems, identity verification, protection products, or other marketplace safeguards.

37. VEHICLE THEFT

If a vehicle is reported stolen, JoyRide may immediately:

  • Suspend the Guest account;
  • Suspend the Host account;
  • Preserve relevant records;
  • Notify applicable parties;
  • Cooperate with law enforcement;
  • Cooperate with insurers; and
  • Take other appropriate action.

38. VEHICLE ABANDONMENT

A Guest may not abandon a Host Vehicle in an unsafe, illegal, or unauthorized location.

If a vehicle is abandoned, the Guest may be responsible for:

  • Storage;
  • Recovery;
  • Transportation;
  • Administrative costs;
  • Damage; and
  • Other applicable charges.

40. VEHICLE DAMAGE INCIDENTS

Damage should be reported through JoyRide's applicable claims process.

  6. Cooperate with claims procedures; and
  7. Avoid admitting legal liability on behalf of JoyRide or another party.

42. DO NOT ALTER EVIDENCE

Users may not knowingly:

  • Delete relevant photographs;

  • Fabricate documents;
  • Destroy vehicle evidence;

  • Reviewing account history;
  • Reviewing messages;
  • Reviewing photographs;
  • Reviewing GPS or location information where applicable;
  • Reviewing identity-verification information;
  • Reviewing payment information;
  • Contacting the parties;
  • Requesting documents;
  • Requesting vehicle inspection;
  • Contacting insurers;
  • Contacting service providers; or
  • Other lawful investigative methods.

44. USER COOPERATION

Users are expected to reasonably cooperate with legitimate trust-and-safety investigations.

Failure to cooperate may affect:

  • Account status;
  • Booking eligibility;
  • Claims;
  • Protection eligibility; or
  • Other Platform privileges.

45. INVESTIGATION CONFIDENTIALITY

JoyRide may limit disclosure of investigation details where necessary to:

  • Protect privacy;
  • Prevent retaliation;
  • Protect evidence;
  • Protect security systems;
  • Comply with law;
  • Protect reporting parties; or
  • Preserve the integrity of an investigation.

46. EVIDENCE STANDARDS

JoyRide may consider multiple sources of information.

Evidence may include:

  • Direct statements;
  • Photographs;
  • Videos;
  • Messages;
  • Vehicle data;

  • Booking records;
  • Payment records;
  • Inspection reports;
  • Repair records;
  • Police reports;
  • Third-party reports;
  • Prior incident information; and
  • Other relevant information.

JoyRide does not promise that every dispute will have a definitive factual determination.

47. ACCOUNT RESTRICTIONS DURING INVESTIGATION

JoyRide may temporarily:

  • Suspend a Listing;
  • Suspend Booking privileges;
  • Disable Instant Book;
  • Restrict messaging;
  • Restrict payouts;
  • Require additional verification;
  • Require vehicle inspection; or
  • Temporarily suspend an account

while a serious incident is investigated.

Such action may be precautionary and does not necessarily mean JoyRide has reached a final determination.

48. EMERGENCY ACCOUNT SUSPENSION

JoyRide may immediately suspend an account where it reasonably believes immediate action is necessary to protect:

  • Life;
  • Physical safety;
  • Vehicles;
  • Property;
  • Personal information;
  • Payment systems;
  • The Platform; or
  • Other users.

49. TEMPORARY SUSPENSION

A temporary suspension may be used while JoyRide evaluates:

  • A safety report;
  • Fraud;
  • Insurance concerns;
  • Vehicle condition;
  • Identity concerns;
  • Payment issues;
  • Repeated policy violations;
  • Claims;
  • Law-enforcement requests; or
  • Other trust-and-safety concerns.

50. PERMANENT BAN

JoyRide may permanently prohibit a person from participating in the Platform when permitted by law and appropriate under its policies.

Potential grounds include:

  • Serious violence;
  • Serious criminal conduct;
  • Credible threats;
  • Fraud;
  • Identity theft;
  • Repeated dangerous driving;
  • Repeated serious safety violations;
  • Severe abuse of the Platform;
  • Repeated ban evasion;
  • Material insurance fraud;
  • Intentional vehicle theft;
  • Serious harassment;
  • Exploitation;
  • Repeated fraudulent claims; or
  • Other serious conduct inconsistent with safe marketplace participation.

51. NO GUARANTEE OF CONTINUED ACCESS

JoyRide does not guarantee that any Host or Guest will retain access to the Platform indefinitely.

Safety and eligibility decisions may result in restrictions even where a user has previously completed successful Bookings.

52. ACCOUNT REINSTATEMENT

Depending on the circumstances, JoyRide may permit an account to be reinstated.

Reinstatement may require:

  • Identity verification;
  • Updated documentation;
  • Vehicle inspection;
  • Proof of insurance;
  • Safety training;
  • Resolution of outstanding balances;
  • Completion of an appeal;
  • Other corrective action.

JoyRide does not guarantee reinstatement.

53. APPEALS

Where an appeal process is available, an affected user may request review of an eligible account action.

An appeal should include:

  • Account information;
  • Relevant Booking;
  • Date of incident;
  • Explanation of the dispute;
  • Supporting evidence; and
  • Requested correction or review.

54. APPEAL REVIEW

JoyRide may review:

  • Original reports;
  • New evidence;
  • Account history;
  • Applicable policies;
  • Investigation records; and
  • Other relevant information.

JoyRide may uphold, modify, or reverse an action where appropriate.

55. APPEAL LIMITATIONS

Certain actions may not be eligible for appeal or may have limited appeal rights where:

  • Immediate safety risks exist;
  • Law enforcement requires action;
  • Fraud prevention requires confidentiality;
  • Applicable law requires restriction;
  • The account has been permanently terminated for serious misconduct; or
  • Other circumstances make reconsideration inappropriate.

Nothing limits legally required appeal or review rights.

56. RETALIATION PROHIBITED

JoyRide prohibits retaliation against a person for making a good-faith safety report.

Retaliation may include:

  • Threats;
  • Harassment;
  • Account manipulation;
  • False reports;
  • Intimidation;
  • Attempted doxxing;
  • Off-platform harassment; or
  • Other retaliatory conduct.

57. FALSE COUNTER-REPORTS

Submitting a false report solely to retaliate against another user may itself constitute a policy violation.

JoyRide may consider the context of repeated or retaliatory reports.

58. SAFETY REPORTS AND PRIVACY

Safety reports may contain sensitive personal information.

JoyRide will handle report information according to its Privacy Policy and applicable law.

Information may be shared when reasonably necessary with:

  • Insurers;
  • Claims administrators;
  • Payment processors;
  • Verification providers;
  • Service providers;
  • Law enforcement;
  • Government authorities;
  • Legal advisers; or
  • Other authorized parties.

59. LOCATION INFORMATION

JoyRide may use location information where disclosed and permitted for purposes such as:

  • Trip operations;
  • Safety;
  • Fraud prevention;
  • Vehicle recovery;
  • Claims;
  • Customer support;
  • Incident investigation; and
  • Compliance.

The JoyRide Privacy Policy governs applicable data practices.

60. COMMUNICATION RECORDS

JoyRide may retain relevant Platform communications for purposes including:

  • Safety;
  • Fraud prevention;
  • Customer support;
  • Claims;
  • Dispute resolution;
  • Policy enforcement; and
  • Legal compliance.

Retention is subject to JoyRide's Privacy Policy and applicable law.

61. TRUST AND SAFETY TECHNOLOGY

JoyRide may use automated or technological systems to identify potentially risky activity.

These systems may evaluate signals such as:

  • Account activity;
  • Booking patterns;
  • Payment activity;
  • Device information;
  • Identity verification;
  • Vehicle information;
  • Prior incidents; and
  • Other relevant signals.

Automated systems may result in additional verification or temporary restrictions.

62. HUMAN REVIEW

Where appropriate, JoyRide may conduct human review of significant safety or account decisions.

The extent and timing of human review may depend on:

  • Severity;
  • Available evidence;
  • Applicable law;
  • Operational circumstances; and
  • Safety considerations.

63. NO AUTOMATIC DETERMINATION OF GUILT

A temporary suspension or investigation does not necessarily mean that JoyRide has concluded that a user violated a policy.

JoyRide may take precautionary action while investigating.

64. THIRD-PARTY REPORTS

JoyRide may receive reports from:

  • Guests;
  • Hosts;
  • Witnesses;
  • Law enforcement;
  • Insurers;
  • Payment providers;
  • Service providers;
  • Other users; or
  • Other third parties.

JoyRide may investigate credible third-party reports.

  • Court orders;
  • Search warrants;
  • Government requests;
  • Regulatory inquiries; and
  • Other legally valid processes.

67. INSURANCE AND CLAIMS INVESTIGATIONS

Trust-and-safety investigations may occur separately from insurance claims investigations.

A safety decision does not necessarily determine whether a claim is covered.

Coverage remains subject to the applicable insurance policy and protection terms.

68. DAMAGE CLAIMS VS. SAFETY VIOLATIONS

A vehicle damage dispute does not automatically mean that a user committed a safety violation.

Likewise, a safety violation may exist even if no physical damage occurred.

JoyRide may evaluate the issues separately.

69. NO-SHOWS VS. SAFETY INCIDENTS

A simple failure to appear is generally handled under the applicable cancellation and no-show procedures.

A no-show involving suspected fraud, theft, threats, or other serious misconduct may be escalated as a safety incident.

70. HOST QUALITY CONCERNS

Repeated Guest complaints concerning a Host Vehicle may result in:

  • Additional documentation requirements;
  • Inspection;
  • Temporary listing suspension;
  • Removal from Instant Book;
  • Reduced visibility;
  • Required corrective action; or
  • Account action.

71. GUEST QUALITY CONCERNS

Repeated Host reports concerning Guest conduct may result in:

  • Additional verification;
  • Booking restrictions;
  • Temporary suspension;
  • Removal of booking privileges;
  • Required corrective action; or
  • Permanent account action.

72. REPEATED INCIDENTS

JoyRide may consider repeated incidents when evaluating marketplace eligibility.

Relevant patterns may include:

  • Repeated no-shows;
  • Repeated cancellations;
  • Repeated damage claims;
  • Repeated unauthorized-driver reports;
  • Repeated dangerous-driving reports;
  • Repeated fraud reports;
  • Repeated harassment;
  • Repeated Listing inaccuracies; or
  • Other repeated violations.

A prior incident does not automatically establish that a new allegation is true.

73. SERIOUSNESS AND PROPORTIONALITY

JoyRide may consider factors including:

  • Severity;
  • Immediacy of risk;
  • Evidence;
  • Intent;
  • Prior conduct;
  • Frequency;
  • Cooperation;
  • Impact on others;
  • Applicable law; and
  • Whether corrective action is reasonably possible.

JoyRide may take immediate action when safety requires it.

74. HOST VEHICLE BAN

JoyRide may permanently prohibit a particular vehicle from the Platform even if the Host's account remains active.

Reasons may include:

  • Unsafe condition;
  • Repeated incidents;
  • Fraud;
  • Misrepresentation;
  • Insurance problems;
  • Unlawful vehicle status;
  • Repeated Guest complaints; or
  • Other legitimate safety concerns.

75. HOST ACCOUNT BAN

JoyRide may prohibit a Host from listing additional vehicles or participating as a Host.

76. GUEST ACCOUNT BAN

JoyRide may prohibit a Guest from booking or driving Host Vehicles.

77. PLATFORM-WIDE BAN

Where appropriate, a user may be prohibited from participating in any JoyRide marketplace activity.

78. BAN EVASION CONSEQUENCES

Attempting to evade a ban may result in immediate suspension or termination of related accounts.

JoyRide may use reasonable information to identify potential ban evasion, subject to applicable law and the Privacy Policy.

79. THIRD-PARTY SERVICE PROVIDERS

JoyRide may rely on third parties for:

  • Identity verification;
  • Background or driving-record checks;
  • Payment processing;
  • Fraud detection;
  • Claims administration;
  • Roadside assistance;
  • Vehicle inspection;
  • Safety technology;
  • Customer support; and
  • Other trust-and-safety functions.

Those providers may have their own terms and privacy policies.

80. USER RESPONSIBILITY FOR SAFETY

Every Host and Guest remains responsible for using reasonable care.

JoyRide's safety systems do not replace:

  • Safe driving;
  • Vehicle maintenance;
  • Legal compliance;
  • Emergency services;
  • Insurance;
  • Personal judgment; or
  • Other safety responsibilities.

81. SAFETY SYSTEM LIMITATIONS

No identity-verification system, fraud system, vehicle inspection, GPS system, review system, or other safety technology can eliminate all risks.

JoyRide does not guarantee that:

  • Every user is safe;
  • Every vehicle is defect-free;
  • Every identity is genuine;
  • Every report is detected;
  • Every fraudulent transaction will be prevented; or
  • Every incident will be prevented.

82. HOST SAFETY RESPONSIBILITIES

Hosts should:

  • Maintain vehicles;
  • Follow inspection requirements;
  • Accurately disclose vehicle condition;
  • Maintain required insurance;
  • Keep pickup information accurate;
  • Report safety concerns;
  • Avoid unsafe interactions;
  • Preserve relevant evidence; and
  • Cooperate with legitimate investigations.

83. GUEST SAFETY RESPONSIBILITIES

  • Drive lawfully;
  • Follow vehicle instructions;
