TRIP PROTECTION AND PLATFORM PROTECTION TERMS

Effective Date: September 20, 2026 Version: 1.0

These Trip Protection and Platform Protection Terms (“Protection Terms”) govern the Trip Protection, Vehicle Protection, liability protection, contractual damage protection, and related protection products and services offered by JoyRide (“JoyRide,” “we,” “us,” or “our”) in connection with a vehicle booked through the JoyRide marketplace.

These Protection Terms are incorporated into and form part of JoyRide’s Terms of Service (“Terms”).

By purchasing, accepting, or using a JoyRide protection product, you agree to these Protection Terms.

If a conflict exists between these Protection Terms and the JoyRide Terms, these Protection Terms control with respect to the specific protection product, claim, loss, or protection benefit addressed here.

Where an insurance policy, certificate, endorsement, protection-plan document, or state-specific disclosure applies to a particular protection product, that document controls to the extent required by law.

1. IMPORTANT INFORMATION ABOUT JOYRIDE PROTECTION

JoyRide operates a peer-to-peer vehicle marketplace.

JoyRide is not the owner of every vehicle listed on the marketplace and does not itself own the vehicles merely because they are listed through the Services.

Depending on the vehicle, location, trip, and protection option selected, JoyRide may provide or facilitate one or more of the following:

  1. Commercial automobile liability insurance;
  2. Physical-damage protection;
  3. Contractual assumption of responsibility for certain vehicle damage or loss;
  4. Guest protection;
  5. Host protection;
  6. Roadside assistance;
  7. Claims administration;
  8. Other protection benefits specifically disclosed during booking.

The exact protection available for a particular trip will be shown to the applicable user before the protection is purchased or accepted.

No protection product provides coverage for every loss.

Protection is subject to:

  • These Protection Terms;
  • The applicable insurance policy;
  • Certificate of insurance;
  • Endorsements;
  • Declarations;
  • Protection-plan terms;
  • Applicable state law;
  • The specific protection option purchased;
  • The trip dates and times;
  • The vehicle involved; and
  • The facts and circumstances of the loss.

Where an insurance policy applies, the insurance policy is the controlling document concerning insurance coverage.

2. DEFINITIONS

For these Protection Terms:

“Guest”

Means an approved person who books or operates a vehicle through JoyRide.

“Host”

Means a vehicle owner or other person authorized by JoyRide to list a vehicle on the marketplace.

“Authorized Driver”

Means a Guest or additional driver who has been approved by JoyRide and is permitted to operate the vehicle during the applicable trip.

“Vehicle”

Means the vehicle identified in the applicable booking.

“Trip”

Means the period beginning when the Guest receives or takes possession or control of the Vehicle and ending when the Vehicle is returned to the Host or another location authorized by JoyRide.

“Trip Period”

Means the specific dates and times shown in the applicable reservation, including any extension expressly approved by JoyRide.

“Protection Fee”

Means the fee charged for a particular protection product.

“Protection Product”

Means a protection option made available by JoyRide in connection with a Trip.

“Trip Protection”

Means the protection product selected by a Guest or otherwise included in the applicable booking.

“Vehicle Protection”

Means protection relating to physical damage to or loss of the Vehicle, subject to the applicable terms.

“Covered Loss”

Means a loss that qualifies for protection under the applicable Protection Product, insurance policy, certificate, or contractual protection terms.

“Excluded Loss”

Means a loss that is excluded from protection under these Protection Terms, the applicable policy, certificate, or applicable law.

“Claim”

Means a request for payment, protection, reimbursement, or other benefits relating to an alleged Covered Loss.

“Protection Provider”

Means JoyRide, an insurance carrier, claims administrator, or other entity responsible for providing or administering a particular protection benefit.

3. WHO MAY PURCHASE OR RECEIVE PROTECTION

Protection may be available to:

  • Guests;
  • Authorized Drivers;
  • Hosts;
  • Vehicle owners;
  • Vehicle occupants; or
  • Other persons specifically identified in the applicable protection documents.

Eligibility may depend on:

  • Age;
  • Driver's-license status;
  • Identity verification;
  • Vehicle eligibility;
  • Trip location;
  • Vehicle type;
  • Trip purpose;
  • Applicable law;
  • Insurance availability;
  • Protection-plan availability; and
  • Other underwriting or marketplace requirements.

JoyRide may refuse to provide a Protection Product where doing so would violate applicable law, insurance requirements, underwriting rules, or JoyRide's agreements with its insurers or providers.

4. WHEN PROTECTION BECOMES EFFECTIVE

Unless otherwise stated in the applicable booking:

Protection begins only after:

  1. The Guest has completed the required booking process;
  2. The Protection Product has been accepted or purchased;
  3. The required Protection Fee has been paid or otherwise successfully processed;
  4. The Guest has been approved to drive;
  5. The Vehicle has been released for the Trip; and
  6. The Trip has begun.

Protection does not apply merely because a user has created a JoyRide account.

Protection does not apply to a reservation that has been cancelled before the protection period begins.

5. WHEN PROTECTION ENDS

Protection ends at the earliest of:

  1. The end of the applicable Trip Period;
  2. The time the Vehicle is returned;
  3. The time the Vehicle is recovered following theft;
  4. The time the Trip is terminated by JoyRide;
  5. The time the Guest relinquishes possession of the Vehicle;
  6. The expiration or cancellation of the applicable protection;
  7. Any other time specified in the applicable insurance policy or protection document.

Protection does not automatically continue after the scheduled return time.

If a Guest keeps the Vehicle beyond the scheduled return time without JoyRide's authorization, protection may be affected or terminated as provided by the applicable protection documents.

6. PROTECTION OPTIONS

JoyRide may offer different protection levels.

Examples may include:

Standard Protection

Provides the protection benefits disclosed during checkout, subject to applicable exclusions, limits, fees, and conditions.

Enhanced Protection

May provide additional protection or reduce the Guest's financial responsibility for certain Covered Losses.

Minimum Protection

May provide a lower level of protection and may leave the Guest responsible for a greater portion of certain losses.

JoyRide may change the protection options offered to Guests from time to time.

The protection option actually purchased for a particular Trip will control that Trip.

7. PROTECTION IS SPECIFIC TO THE BOOKING

Protection applies only to:

  • The Vehicle identified in the booking;
  • The Guest and Authorized Drivers identified or approved for the booking;
  • The Trip;
  • The Trip Period; and
  • The geographic area permitted by the applicable protection terms.

Protection cannot be transferred to:

  • Another vehicle;
  • Another person;
  • Another Host;
  • Another Guest;
  • Another Trip; or
  • Another reservation.

8. LIABILITY PROTECTION

Where commercial liability insurance is provided for a Trip, the applicable insurance policy and certificate determine:

  • Who is insured;
  • What liability is covered;
  • The applicable limits;
  • Applicable deductibles or retentions;
  • Exclusions;
  • Defense obligations;
  • Conditions;
  • Geographic scope;
  • Claims procedures; and
  • Other insurance terms.

JoyRide will not represent that liability coverage exists in an amount greater than the applicable insurance policy provides.

Where no insurance coverage applies, the Guest and/or Host may remain personally responsible for liability arising from their conduct to the extent permitted by law.

9. THIRD-PARTY BODILY INJURY AND PROPERTY DAMAGE

Subject to the applicable insurance policy and law, liability protection may respond to certain claims arising from:

  • Bodily injury to third parties;
  • Death;
  • Damage to third-party property; or
  • Other covered liability claims.

Liability protection does not automatically cover:

  • Intentional conduct;
  • Criminal conduct;
  • Unauthorized use;
  • Prohibited vehicle use;
  • Losses occurring outside the Trip Period;
  • Losses occurring outside the geographic scope of coverage;
  • Claims excluded by the applicable policy; or
  • Amounts above applicable policy limits.

10. LIABILITY LIMITS

The exact liability limits applicable to a Trip will be determined by:

  1. The applicable insurance policy;
  2. The applicable certificate;
  3. Applicable endorsements;
  4. Applicable state law; and
  5. The protection disclosure presented during booking.

JoyRide will disclose applicable limits where required by law.

No statement in these Protection Terms increases an insurance policy's limits.

If a law requires greater coverage than a general provision in these Protection Terms, the legally required coverage will apply to the extent required.

11. VEHICLE PHYSICAL DAMAGE PROTECTION

Depending on the protection option purchased, JoyRide may provide or facilitate protection for certain physical damage to the Vehicle occurring during the Trip.

Covered damage may include, depending on the applicable Protection Product:

  • Collision damage;
  • Accidental physical damage;
  • Certain comprehensive-type losses;
  • Certain vandalism;
  • Certain theft-related losses; or
  • Other specifically identified physical losses.

The exact scope of protection is determined by the applicable Protection Product and policy.

12. GUEST DAMAGE RESPONSIBILITY

A Guest remains responsible for losses caused by the Guest or an Authorized Driver to the extent:

  • The loss is excluded from protection;
  • The loss exceeds applicable protection limits;
  • The Guest's protection does not apply;
  • The Guest violated these Protection Terms;
  • The Guest violated the Terms;
  • The Guest violated applicable law; or
  • The Guest engaged in prohibited conduct.

Protection does not mean that a Guest has unlimited or unconditional immunity from responsibility for vehicle damage.

13. PROTECTION DEDUCTIBLE OR GUEST RESPONSIBILITY

If the selected Protection Product includes a deductible, retention, or Guest responsibility amount, the amount will be disclosed before purchase.

If the applicable Protection Product has no deductible or Guest responsibility amount, JoyRide will not charge a deductible for a Covered Loss except where:

  • The applicable policy permits recovery;
  • The loss is excluded from protection;
  • The Guest breached these Protection Terms;
  • The Guest engaged in prohibited conduct; or
  • Applicable law permits another recovery.

JoyRide will not represent a protection option as “zero responsibility” if the Guest can still be charged for excluded losses or other amounts permitted under these Terms.

14. LOSSES THAT ARE GENERALLY NOT PROTECTED

Unless the applicable protection document expressly states otherwise, protection does not apply to:

  1. Intentional damage;
  2. Fraud;
  3. Theft by an unauthorized driver;
  4. Damage caused while committing a crime;
  5. Damage caused while fleeing law enforcement;
  6. Damage caused while driving under the influence of alcohol or drugs;
  7. Damage caused while unlawfully impaired;
  8. Racing;
  9. Track use;
  10. Speed contests;
  11. Off-road use;
  12. Use on unpaved or unsuitable terrain when prohibited;
  13. Towing;
  14. Pushing another vehicle;
  15. Commercial delivery;
  16. Rideshare activity;
  17. Taxi or for-hire activity;
  18. Subleasing;
  19. Unauthorized rental;
  20. Use by an unauthorized driver;
  21. Use outside permitted geographic areas;
  22. International border crossings unless specifically authorized;
  23. Excessive or unauthorized mileage where applicable;
  24. Mechanical failure caused by misuse;
  25. Engine damage caused by improper operation;
  26. Transmission damage caused by misuse;
  27. Damage caused by improper fuel;
  28. Damage caused by failure to maintain required fluid levels;
  29. Damage caused by continued driving after a warning or malfunction;
  30. Damage resulting from racing or competition;
  31. Damage resulting from overloading;
  32. Damage resulting from carrying prohibited materials;
  33. Damage resulting from commercial use;
  34. Damage caused by modifications;
  35. Damage caused by tampering with safety systems;
  36. Damage caused by disabling or tampering with tracking or security equipment;
  37. Wear and tear;
  38. Mechanical deterioration;
  39. Pre-existing damage;
  40. Normal depreciation;
  41. Diminution in value unless expressly covered;
  42. Loss of use unless expressly covered;
  43. Lost revenue;
  44. Lost business opportunities;
  45. Personal belongings;
  46. Cash;
  47. Electronic devices;
  48. Personal documents;
  49. Damage to property owned by the Guest;
  50. Damage intentionally concealed or misrepresented;
  51. Losses arising from false information provided during booking;
  52. Losses arising from a materially fraudulent claim;
  53. Losses outside the Trip Period;
  54. Losses occurring before possession of the Vehicle;
  55. Losses occurring after unauthorized possession continues;
  56. Losses caused by breach of the applicable insurance policy;
  57. Losses excluded by applicable law or the applicable insurance policy; and
  58. Any other specifically excluded loss.

15. PROHIBITED USE INVALIDATING PROTECTION

Protection may be denied or limited where a loss results from prohibited use.

Prohibited uses include:

  • Racing;
  • Drag racing;
  • Track driving;
  • Speed competitions;
  • Off-roading;
  • Towing;
  • Pushing another vehicle;
  • Commercial delivery;
  • Rideshare;
  • Taxi service;
  • Subleasing;
  • Unauthorized rental;
  • Transporting hazardous materials;
  • Transporting illegal substances;
  • Use for criminal activity;
  • Driving under the influence;
  • Driving while unlawfully impaired;
  • Allowing an unauthorized driver to operate the Vehicle;
  • Tampering with safety equipment;
  • Tampering with GPS or security systems;
  • Removing vehicle identification information;
  • Crossing an international border without authorization;
  • Excessive or prohibited mileage;
  • Carrying prohibited loads;
  • Using the Vehicle in a manner that violates law;
  • Using the Vehicle in a manner that violates the Host's restrictions; or
  • Any other prohibited use identified during booking.

16. UNAUTHORIZED DRIVERS

Protection generally applies only to approved drivers.

A Guest must not permit another person to operate the Vehicle unless that person:

  1. Has been approved by JoyRide;
  2. Meets JoyRide's driver requirements;
  3. Has completed required verification;
  4. Has been added as an Authorized Driver; and
  5. Is permitted to drive under the applicable booking.

A Guest who permits an unauthorized driver to operate the Vehicle may lose some or all protection benefits to the extent permitted by applicable law and the applicable policy.

The Guest may also remain responsible for losses caused by the unauthorized driver.

17. DRIVING UNDER THE INFLUENCE

Protection does not provide protection for losses caused while a driver is:

  • Driving under the influence of alcohol;
  • Driving under the influence of drugs;
  • Driving while unlawfully impaired; or
  • Operating the Vehicle while otherwise prohibited from driving.

Nothing in these Protection Terms prevents an insurer or other legally responsible party from responding to claims where required by law.

18. INTENTIONAL OR RECKLESS CONDUCT

Protection is not intended to protect against intentional damage or intentionally caused loss.

Protection may also be limited or denied for:

  • Willful misconduct;
  • Fraud;
  • Reckless conduct;
  • Criminal conduct; or
  • Other conduct excluded by the applicable policy or law.

Where a state law limits the circumstances under which contractual vehicle protection may be denied, that law will control.

19. THEFT OF THE VEHICLE

If the Vehicle is stolen during a Trip, the Guest must:

  1. Immediately contact law enforcement;
  2. Obtain a police report or report number;
  3. Notify JoyRide as soon as reasonably possible;
  4. Provide all requested information;
  5. Provide the Vehicle's last known location;
  6. Provide information concerning keys;
  7. Cooperate with recovery efforts;
  8. Cooperate with insurance investigations;
  9. Preserve evidence; and
  10. Take reasonable steps to prevent further loss.

Failure to promptly report a theft may affect protection to the extent permitted by applicable law and the applicable policy.

20. LOST OR STOLEN KEYS

Lost, stolen, damaged, or improperly retained keys may result in charges.

Protection generally does not cover:

  • Lost keys;
  • Replacement keys;
  • Key programming;
  • Locksmith charges;
  • Remote-control replacement;
  • Key-fob replacement; or
  • Costs associated with a Guest's failure to return keys.

If key replacement is covered under a specific Protection Product, the applicable terms will control.

21. PERSONAL PROPERTY

Unless expressly stated otherwise, vehicle protection does not cover personal belongings left inside a Vehicle.

Examples include:

  • Phones;
  • Computers;
  • Cameras;
  • Wallets;
  • Luggage;
  • Clothing;
  • Jewelry;
  • Cash;
  • Documents; and
  • Other personal property.

Guests should remove personal property before returning a Vehicle.

22. MECHANICAL FAILURE

Protection for physical damage does not automatically mean that mechanical failures are covered.

Examples of generally excluded mechanical losses include:

  • Engine failure;
  • Transmission failure;
  • Battery failure;
  • Tire wear;
  • Brake wear;
  • Clutch wear;
  • Suspension wear;
  • Routine maintenance;
  • Failure caused by age;
  • Failure caused by normal use; and
  • Mechanical deterioration.

Mechanical failures caused by an accident may be evaluated as part of an applicable damage claim.

23. TIRES, WHEELS, GLASS, AND UNDERCARRIAGE

Protection for tires, wheels, glass, mirrors, undercarriage components, or similar items depends on the selected Protection Product.

Unless expressly covered, protection may exclude:

  • Tire punctures;
  • Tire wear;
  • Wheel damage;
  • Curb damage;
  • Windshield damage;
  • Glass chips;
  • Undercarriage damage;
  • Road debris damage; and
  • Cosmetic damage.

Any specific coverage will be disclosed in the applicable protection documentation.

24. INTERIOR DAMAGE

Protection may cover certain accidental interior damage only if the applicable Protection Product expressly provides such coverage.

Examples of damage that may be excluded include:

  • Burns;
  • Cigarette or vaping damage;
  • Permanent stains;
  • Pet damage;
  • Excessive cleaning;
  • Odor;
  • Torn upholstery;
  • Damage caused by transporting prohibited materials; and
  • Intentional damage.

25. SMOKING AND VAPING

Smoking and vaping may be prohibited in JoyRide Vehicles.

Protection generally does not cover:

  • Smoke odor;
  • Cigarette burns;
  • Vape residue;
  • Ash damage;
  • Odor-removal costs; or
  • Other smoking-related cleaning costs.

The Guest may be responsible for applicable cleaning or remediation charges.

26. PET DAMAGE

Pets may be permitted in some Vehicles subject to Host restrictions.

Protection generally does not cover:

  • Pet hair;
  • Pet odor;
  • Scratches;
  • Upholstery damage;
  • Interior damage; or
  • Other pet-related cleaning or damage costs.

27. FUEL AND CHARGING

Protection does not cover:

  • Fuel charges;
  • Charging charges;
  • Misfueling;
  • Empty-tank charges;
  • Charging penalties; or
  • Costs resulting from failure to follow vehicle-specific charging requirements,

unless expressly stated otherwise.

Improper fuel that damages the Vehicle may be treated as a damage claim.

28. TOLLS, PARKING, AND TRAFFIC VIOLATIONS

Protection does not cover:

  • Tolls;
  • Parking fees;
  • Parking tickets;
  • Traffic tickets;
  • Speeding tickets;
  • Camera citations;
  • Impound charges;
  • Registration violations;
  • Moving violations; or
  • Other governmental fines.

The Guest may be responsible for these charges and reasonable administrative costs to the extent permitted by law.

29. ACCIDENT PROCEDURE

If an accident occurs, the Guest must prioritize safety.

The Guest should:

  1. Stop safely;
  2. Call emergency services when necessary;
  3. Contact law enforcement when required;
  4. Exchange legally required information;
  5. Take photographs if safe;
  6. Obtain witness information where appropriate;
  7. Notify JoyRide promptly;
  8. Cooperate with claims personnel;
  9. Preserve evidence; and
  10. Avoid admitting liability or agreeing to a settlement on behalf of JoyRide or an insurer.

The Guest should not:

  • Leave the scene unlawfully;
  • Conceal the accident;
  • Repair the Vehicle without authorization;
  • Dispose of evidence;
  • Make false statements;
  • Admit fault on behalf of JoyRide or an insurer; or
  • Agree to pay another person privately for an accident without authorization.

30. CLAIM REPORTING DEADLINES

Claims should be reported to JoyRide as soon as reasonably possible.

Unless a shorter period is required by the applicable insurance policy or law, JoyRide expects Guests and Hosts to report:

  • Accidents;
  • Theft;
  • Damage;
  • Loss;
  • Vandalism;
  • Third-party claims; and
  • Other incidents

within 24 hours of discovering the incident, or as soon as reasonably possible when circumstances prevent immediate reporting.

Failure to report promptly may affect a claim where permitted by applicable law and the applicable policy.

31. CLAIM DOCUMENTATION

JoyRide or its Protection Provider may request:

  • Photographs;
  • Videos;
  • Police reports;
  • Accident reports;
  • Driver information;
  • Witness information;
  • Repair estimates;
  • Repair invoices;
  • Vehicle condition reports;
  • Mileage records;
  • Booking information;
  • Communication records;
  • Receipts;
  • Proof of ownership;
  • Vehicle registration;
  • Insurance information;
  • Medical documentation where relevant;
  • Other information reasonably necessary to evaluate a claim.

Users must provide truthful and complete information.

32. FALSE OR FRAUDULENT CLAIMS

A person must not submit a fraudulent claim.

Fraud includes:

  • Staging an accident;
  • Intentionally damaging a Vehicle;
  • Misrepresenting when damage occurred;
  • Concealing pre-existing damage;
  • Submitting false photographs;
  • Submitting false receipts;
  • Inflating repair costs;
  • Misrepresenting the identity of the driver;
  • Concealing an unauthorized driver;
  • Falsifying police reports;
  • Making materially false statements; or
  • Otherwise attempting to obtain benefits through deception.

Fraud may result in:

  • Denial of protection;
  • Account suspension;
  • Account termination;
  • Recovery of amounts paid;
  • Referral to law enforcement;
  • Civil claims; and
  • Other remedies permitted by law.

33. PRE-TRIP VEHICLE CONDITION

Hosts are responsible for accurately documenting the condition of their Vehicles.

JoyRide may require:

  • Pre-trip photographs;
  • Post-trip photographs;
  • Mileage;
  • Fuel level;
  • Charging level;
  • Existing damage documentation;
  • Vehicle condition reports; and
  • Other evidence.

Guests should inspect the Vehicle before driving and report pre-existing damage through the JoyRide process.

Failure to document pre-existing damage may affect a subsequent claim.

34. POST-TRIP INSPECTION

A Host or JoyRide may inspect a Vehicle after a Trip.

If damage is discovered, JoyRide may compare:

  • Pre-trip photographs;
  • Post-trip photographs;
  • Vehicle condition reports;
  • Mileage;
  • Trip records;
  • Messages;
  • Inspection reports;
  • Repair estimates; and
  • Other relevant evidence.

JoyRide will evaluate claims based on the available evidence and applicable protection terms.

35. DAMAGE ASSESSMENT

Damage claims may be evaluated using:

  • Physical inspection;
  • Photographs;
  • Video;
  • Repair estimates;
  • Repair invoices;
  • Manufacturer specifications;
  • Parts pricing;
  • Labor rates;
  • Independent appraisal;
  • Market information; and
  • Other reasonable evidence.

JoyRide may require an independent inspection where appropriate.

36. REPAIR STANDARDS

Where permitted by applicable law and the applicable Protection Product, repair costs may be based on reasonable and customary costs necessary to restore the Vehicle to its pre-loss condition.

JoyRide or its Protection Provider may consider:

  • OEM parts;
  • Equivalent parts;
  • Reconditioned parts;
  • Aftermarket parts;
  • Labor;
  • Paint;
  • Materials; and
  • Other reasonable repair costs.

Nothing in these Terms guarantees the use of any particular repair facility or part.

37. TOTAL LOSS

If a Vehicle is determined to be a total loss, the applicable insurance policy or protection terms will determine how the loss is valued.

Potential considerations may include:

  • Actual cash value;
  • Market value;
  • Salvage value;
  • Applicable deductibles;
  • Applicable limits;
  • Taxes;
  • Fees;
  • Existing liens; and
  • Other legally applicable factors.

JoyRide does not guarantee a specific valuation unless expressly stated in the applicable policy or protection document.

38. DIMINUTION IN VALUE

Unless expressly provided by the applicable Protection Product or required by applicable law, protection does not automatically include compensation for diminished resale value after repairs.

39. LOSS OF USE

Unless expressly provided, protection does not automatically cover a Host's:

  • Lost rental income;
  • Lost booking revenue;
  • Lost business opportunity;
  • Loss of availability; or
  • Other consequential loss.

40. DEPRECIATION AND WEAR

Protection is not intended to pay for:

  • Normal wear;
  • Depreciation;
  • Maintenance;
  • Aging;
  • Ordinary mechanical deterioration; or
  • Pre-existing conditions.

41. HOST RESPONSIBILITIES

Hosts must:

  1. Accurately describe their Vehicle;
  2. Disclose known damage;
  3. Maintain the Vehicle in safe operating condition;
  4. Complete required inspections;
  5. Maintain required registration;
  6. Comply with applicable law;
  7. Maintain required personal or commercial insurance;
  8. Provide accurate vehicle information;
  9. Not intentionally conceal damage;
  10. Cooperate with claims;
  11. Preserve relevant evidence;
  12. Not make unauthorized repairs that interfere with a claim;
  13. Provide requested documentation; and
  14. Comply with applicable JoyRide requirements.

42. HOST'S PERSONAL INSURANCE

Hosts are responsible for understanding their own automobile insurance.

A Host should confirm with their insurer that the Vehicle may be used through a peer-to-peer car-sharing marketplace.

JoyRide does not guarantee that a Host's personal automobile insurance will respond to a Trip.

A Host's policy may contain exclusions for:

  • Rental;
  • Sharing;
  • Commercial use;
  • Business use;
  • For-hire use; or
  • Other marketplace activity.

JoyRide's protection does not automatically replace insurance the Host is legally required to maintain.

43. GUEST'S PERSONAL INSURANCE

Guests are responsible for maintaining any automobile insurance they are legally required to maintain.

Guests should review their own insurance policy and any applicable credit-card benefits before booking.

A Guest's personal insurance may or may not provide coverage during a peer-to-peer car-sharing Trip.

JoyRide does not guarantee that a Guest's personal insurance will respond.

Where applicable law or the applicable insurance policy requires another insurance policy to respond first, that requirement will apply.

44. PRIMARY AND EXCESS COVERAGE

Whether JoyRide's protection is primary, secondary, excess, or otherwise depends on the applicable insurance policy and applicable law.

JoyRide will not characterize protection as “primary” or “secondary” unless that characterization is supported by the applicable policy and required disclosures.

45. OTHER INSURANCE

If another insurance policy may apply to a loss, the Guest or Host must cooperate with reasonable requests for information concerning that policy.

JoyRide or its Protection Provider may coordinate claims with:

  • Personal automobile insurers;
  • Commercial insurers;
  • Homeowners/renters insurers;
  • Umbrella insurers;
  • Credit-card benefit providers; or
  • Other applicable insurance providers.

No provision of these Protection Terms waives rights that cannot legally be waived.

46. SUBROGATION

To the extent permitted by law and the applicable policy, JoyRide, an insurer, or a Protection Provider may seek recovery from a responsible third party after paying a Covered Loss.

A user must cooperate with reasonable subrogation efforts.

The user must not waive another party's liability or release a responsible third party in a manner that prejudices applicable protection.

47. COOPERATION WITH CLAIMS

Users must reasonably cooperate with claim investigations.

Cooperation may include:

  • Providing documents;
  • Providing statements;
  • Providing photographs;
  • Participating in inspections;
  • Identifying witnesses;
  • Providing insurance information;
  • Providing police reports;
  • Participating in recorded statements where permitted;
  • Providing access to relevant communications; and
  • Providing other reasonably necessary information.

48. FAILURE TO COOPERATE

To the extent permitted by applicable law and the applicable policy, protection may be denied or limited if a user:

  • Refuses to cooperate;
  • Provides materially false information;
  • Conceals material information;
  • Destroys evidence;
  • Refuses a required inspection;
  • Fails to provide required documentation; or
  • Otherwise materially prejudices the claim investigation.

49. CLAIMS INVOLVING THIRD PARTIES

If another person or vehicle is involved in an accident, the Guest should obtain legally required information, including where appropriate:

  • Name;
  • Contact information;
  • Driver's-license information;
  • Insurance information;
  • Vehicle information;
  • License plate;
  • Police report information; and
  • Witness information.

The Guest should not negotiate a private settlement on behalf of JoyRide or an insurer without authorization.

50. ROADSIDE ASSISTANCE

Where roadside assistance is included or separately purchased, it may provide services such as:

  • Towing;
  • Jump-start;
  • Flat-tire assistance;
  • Lockout assistance;
  • Fuel delivery; or
  • Other roadside services.

Roadside assistance is subject to:

  • Service availability;
  • Geographic limitations;
  • Vehicle eligibility;
  • Provider limitations;
  • Applicable service limits; and
  • The specific roadside-assistance terms.

Roadside assistance does not necessarily constitute insurance coverage.

51. EMERGENCY SERVICES

Users should call emergency services immediately when necessary.

Nothing in these Protection Terms requires a user to contact JoyRide before contacting:

  • Police;
  • Fire;
  • Emergency medical services; or
  • Other emergency responders.

52. CLAIMS FOR PERSONAL INJURY

Personal-injury claims are governed by the applicable insurance policy and applicable law.

JoyRide does not guarantee payment of medical expenses merely because an accident occurred.

Users should seek appropriate medical care following an accident.

53. CLAIMS FOR DAMAGE TO THIRD-PARTY PROPERTY

Claims involving damage to another person's property may be handled through applicable liability insurance.

The responsible insurer may investigate:

  • Liability;
  • Damages;
  • Coverage;
  • Policy limits;
  • Applicable exclusions; and
  • Other relevant issues.

54. CLAIMS DECISIONS

Claims will be evaluated based on:

  • The applicable Protection Product;
  • Applicable insurance policies;
  • Applicable law;
  • Evidence;
  • Vehicle condition;
  • Trip records;
  • User statements;
  • Police reports;
  • Inspection results;
  • Other available information.

JoyRide does not guarantee that every submitted claim will be approved.

55. CLAIM APPEALS

If a claim is denied or partially denied, the user may request an explanation and, where available, an internal review.

The applicable insurance policy may provide additional appeal, complaint, appraisal, arbitration, or regulatory rights.

Nothing in these Protection Terms eliminates rights provided by applicable insurance law.

56. INSURANCE REGULATORY RIGHTS

Where protection is provided through insurance, the applicable insurance policy and state insurance laws may provide rights and remedies that cannot be waived by these Protection Terms.

Nothing in these Protection Terms is intended to:

  • Reduce legally required insurance coverage;
  • Eliminate mandatory claims procedures;
  • Eliminate regulatory rights;
  • Waive mandatory insurance protections;
  • Restrict a right that cannot legally be restricted; or
  • Modify an insurance policy.

57. PROTECTION FEE

The Protection Fee will be displayed during the booking process.

The fee may be calculated based on factors including:

  • Vehicle;
  • Trip duration;
  • Location;
  • Protection option;
  • Driver characteristics;
  • Applicable insurance costs;
  • Risk;
  • Applicable taxes; and
  • Other permitted factors.

The Protection Fee is separate from:

  • Vehicle rental/listing price;
  • JoyRide platform fees;
  • Taxes;
  • Young-driver fees;
  • Additional-driver fees;
  • Optional services;
  • Roadside assistance;
  • Other charges.

58. OPTIONAL OR REQUIRED PROTECTION

Where permitted by law, JoyRide may:

  • Require a minimum protection option;
  • Offer optional enhanced protection;
  • Offer multiple protection levels;
  • Include certain protection automatically; or
  • Permit a Guest to decline optional protection.

The checkout page will identify whether a Protection Product is:

  • Required;
  • Included;
  • Optional; or
  • Declined.

JoyRide will not describe optional protection as mandatory unless applicable law or the applicable product requires it.

59. PROTECTION PURCHASE DISCLOSURE

Before purchase, JoyRide will provide applicable information regarding:

  • Protection Fee;
  • Protection option;
  • Applicable limits;
  • Deductible or Guest responsibility, if any;
  • Major exclusions;
  • Coverage period;
  • Geographic scope;
  • Claims process; and
  • Other information required by applicable law.

The information shown at checkout may be incorporated into the applicable Trip Protection agreement.

60. CANCELLATION OF PROTECTION

If a booking is cancelled before protection begins, the Protection Fee may be refundable according to JoyRide's cancellation policy and applicable law.

Once a Trip begins, the Protection Fee may be non-refundable except where:

  • Applicable law requires a refund;
  • JoyRide cancels the Trip;
  • The protection was never effective;
  • The applicable insurance policy provides otherwise; or
  • JoyRide otherwise authorizes a refund.

61. TRIP EXTENSIONS

Protection does not automatically extend merely because a Guest keeps a Vehicle beyond the scheduled return time.

Guests must request an extension through JoyRide.

If JoyRide approves the extension:

  • The Trip Period may be extended;
  • Additional fees may apply;
  • Protection may continue if permitted by the applicable policy; and
  • The applicable protection terms will continue to apply.

An unauthorized extension may result in protection ending at the original scheduled end time.

62. EARLY RETURN

If a Guest returns a Vehicle early, protection generally remains governed by the original Trip Period unless the applicable policy or JoyRide's systems provide otherwise.

Early return does not necessarily result in a refund of the Protection Fee.

63. HOST CANCELLATION

If a Host cancels a booking before the Trip begins, JoyRide may:

  • Refund the Guest;
  • Refund the Protection Fee;
  • Offer replacement transportation or another vehicle where available; or
  • Provide another remedy required by the applicable cancellation policy.

Protection does not continue after a cancelled booking.

64. JOYRIDE CANCELLATION

JoyRide may cancel or terminate a Trip because of:

  • Safety concerns;
  • Fraud;
  • Identity-verification failure;
  • Vehicle safety concerns;
  • Insurance issues;
  • Legal requirements;
  • Payment failure;
  • Prohibited conduct;
  • System errors;
  • Host issues;
  • Emergency circumstances; or
  • Other circumstances permitted by the Terms.

Where a Trip is cancelled before protection begins, JoyRide will process applicable refunds according to its cancellation policy and applicable law.

65. FRAUD AND MISREPRESENTATION

JoyRide may suspend or terminate protection where a user:

  • Provides false information;
  • Misrepresents a vehicle;
  • Misrepresents a driver's identity;
  • Conceals an accident;
  • Conceals an unauthorized driver;
  • Manipulates photographs;
  • Attempts to evade protection limits;
  • Submits fraudulent claims;
  • Uses multiple accounts to evade restrictions; or
  • Otherwise engages in fraud.

66. INTENTIONAL DAMAGE

Intentional damage is not a Covered Loss.

If a Guest intentionally damages a Vehicle, JoyRide or the Host may pursue recovery for:

  • Repair costs;
  • Replacement costs;
  • Towing;
  • Storage;
  • Administrative costs where permitted;
  • Other actual losses; and
  • Other legally recoverable amounts.

67. CRIMINAL ACTIVITY

Protection does not create immunity from criminal liability.

JoyRide may cooperate with law enforcement concerning:

  • Theft;
  • Fraud;
  • Vehicle damage;
  • Drug offenses;
  • DUI;
  • Identity theft;
  • Unauthorized vehicle use; or
  • Other criminal activity.

68. INTERNATIONAL TRAVEL

Unless expressly authorized by JoyRide and permitted by the applicable protection documents, Vehicles may not be taken across international borders.

Protection may not apply to a Vehicle outside the geographic territory specified by the applicable policy.

Guests are responsible for complying with:

  • Immigration requirements;
  • Customs requirements;
  • Vehicle-entry requirements;
  • Insurance requirements;
  • Registration requirements; and
  • Other applicable laws.

69. STATE-SPECIFIC TERMS

Because JoyRide operates nationwide, protection requirements may vary by state.

Where a state's law requires:

  • Specific insurance;
  • Specific disclosures;
  • Specific coverage;
  • Specific claims procedures;
  • Specific limits;
  • Specific cancellation rights;
  • Specific protection disclosures;
  • Specific licensing; or
  • Other consumer protections,

those requirements will apply to eligible Trips in that state.

If state law provides greater protection than these Terms, the applicable law controls.

70. NEW YORK AND OTHER JURISDICTIONS WITH SPECIAL CAR-SHARING RULES

Certain jurisdictions impose specific requirements on peer-to-peer car-sharing programs.

For example, New York law contains specific requirements concerning peer-to-peer car-sharing insurance, program disclosures, optional vehicle protection, claims, and insurance licensing. JoyRide will comply with applicable state-specific requirements and may provide supplemental disclosures or protection terms where necessary.

Nothing in these Protection Terms is intended to replace a state-required disclosure, insurance certificate, or policy document.

71. INSURANCE POLICY CONTROLS

Where insurance applies, the applicable insurance policy controls questions concerning:

  • Coverage;
  • Limits;
  • Exclusions;
  • Conditions;
  • Defense;
  • Claims;
  • Settlement;
  • Subrogation;
  • Deductibles;
  • Geographic scope;
  • Insured persons; and
  • Other insurance terms.

These Protection Terms do not amend an insurance policy unless expressly incorporated into that policy by the insurer.

72. NO PROMISE OF COVERAGE

JoyRide does not promise that every accident, claim, loss, injury, theft, or damage will be covered.

Protection depends on:

  • The selected Protection Product;
  • The facts of the loss;
  • Applicable exclusions;
  • Compliance with these Terms;
  • Applicable law; and
  • The applicable insurance policy.

73. NO DUPLICATIVE RECOVERY

To the extent permitted by law, a claimant may not recover more than the actual covered loss through multiple sources of protection.

JoyRide and/or an insurer may coordinate applicable benefits to prevent duplicate recovery where permitted.

74. RECOVERY FROM RESPONSIBLE PARTIES

If JoyRide, an insurer, or another Protection Provider pays a Covered Loss caused by another responsible person, JoyRide or the Protection Provider may seek recovery from that responsible party to the extent permitted by law.

The Guest and Host agree to reasonably cooperate with such recovery.

75. RELEASES

A release obtained from a Guest, Host, or third party must not be interpreted to eliminate insurance rights or mandatory protections that cannot legally be waived.

Any release will be interpreted consistently with applicable law and the applicable insurance policy.

76. NO WAIVER OF LEGAL RIGHTS

Nothing in these Protection Terms waives rights that cannot legally be waived.

This includes mandatory:

  • Insurance protections;
  • Consumer protections;
  • Claims rights;
  • Regulatory rights;
  • Statutory remedies; and
  • Other non-waivable rights.

77. PROTECTION AND JOYRIDE'S TERMS OF SERVICE

The JoyRide Terms of Service remain applicable to every Trip.

The Terms address matters including:

  • Account requirements;
  • Vehicle eligibility;
  • Driver eligibility;
  • Prohibited uses;
  • Payments;
  • Cancellations;
  • Reviews;
  • Platform rules;
  • Dispute resolution; and
  • Other marketplace matters.

These Protection Terms address the specific protection products associated with a Trip.

78. PROTECTION DOES NOT CHANGE VEHICLE OWNERSHIP

Purchasing a Protection Product does not:

  • Transfer ownership;
  • Create a lease;
  • Create a security interest;
  • Give a Guest ownership rights;
  • Give a Host insurance rights beyond the applicable policy; or
  • Change the marketplace relationship.

79. NO GUARANTEE OF VEHICLE CONDITION

Protection does not guarantee that a Vehicle will:

  • Be mechanically perfect;
  • Be free from defects;
  • Be free from previous repairs;
  • Be free from normal wear;
  • Be free from recalls; or
  • Meet every Guest preference.

JoyRide and Hosts remain responsible for complying with applicable vehicle safety requirements.

80. PROTECTION DOES NOT COVER HOST NEGLIGENCE UNLESS PROVIDED

Protection does not automatically protect a Host from losses arising from:

  • Negligent maintenance;
  • Unsafe vehicle condition;
  • Failure to disclose known defects;
  • Misrepresentation;
  • Illegal vehicle modifications; or
  • Other Host conduct,

unless applicable insurance or protection specifically provides such protection.

81. SUBROGATION AGAINST GUESTS

Where permitted by law and the applicable protection documents, an insurer or Protection Provider may seek recovery from a Guest for an otherwise paid claim where the Guest's conduct falls within an applicable exclusion or recovery provision.

Examples may include:

  • Fraud;
  • Intentional damage;
  • Unauthorized use;
  • Unauthorized drivers;
  • Prohibited use;
  • Material misrepresentation; or
  • Other excluded conduct.

82. CLAIMS AGAINST THIRD PARTIES

A Guest or Host must not intentionally waive or release the rights of JoyRide, an insurer, or another Protection Provider against a responsible third party without authorization.

83. EVIDENCE AND RECORDS

JoyRide may maintain records relevant to protection claims, including:

  • Booking records;
  • Payment records;
  • Identity-verification records;
  • Vehicle condition reports;
  • Photographs;
  • Messages;
  • Trip dates;
  • Location records where lawfully collected;
  • Inspection records;
  • Claim communications; and
  • Other relevant information.

Such information may be used to investigate and resolve claims.

84. PRIVACY

Information collected in connection with a Protection Product will be processed according to the JoyRide Privacy Policy.

Claims may require additional information, including:

  • Identification;
  • Insurance information;
  • Accident information;
  • Vehicle information;
  • Medical information where relevant;
  • Police reports; and
  • Other claim-related information.

JoyRide may share claim information with insurers, claims administrators, legal advisers, law enforcement, Hosts, Guests, and other parties as reasonably necessary and permitted by law.

85. PROTECTION PROVIDER DISCLOSURES

Where an insurer or other Protection Provider is responsible for a particular protection benefit, JoyRide will identify or make available the applicable provider information where required by law.

Insurance Carrier: Not applicable for current platform physical-damage benefits — JoyRide administers contractual Trip Protection (self-funded). Any commercial automobile liability insurance, when provided for a Trip, is disclosed separately with that policy.

Claims Administrator: JoyRide

Policy Number / Program Number: JoyRide Platform Protection Program (contractual) — Version 1.0

Claims contact: JoyRide Support

Claims Email: hello@drivejoyride.app

Certificate / Policy Link: https://www.drivejoyride.app/protection

86. CLAIMS CONTACT

Unless the applicable policy specifies a different procedure, claims should initially be reported through:

JoyRide Claims Portal: https://www.drivejoyride.app/support

Claims Email: hello@drivejoyride.app

Emergency Claims / Roadside Assistance: Call 911 for emergencies. Roadside assistance, when included with a Trip, is disclosed at booking; otherwise contact JoyRide Support.

Emergency services should be contacted first when necessary.

87. CLAIMS REVIEW PROCESS

After a claim is submitted, JoyRide or its Protection Provider may:

  1. Confirm receipt;
  2. Review the booking;
  3. Confirm the applicable protection;
  4. Verify the driver's identity;
  5. Review the Vehicle condition;
  6. Review photographs;
  7. Review police records;
  8. Contact involved parties;
  9. Obtain repair estimates;
  10. Conduct an inspection;
  11. Determine applicable coverage;
  12. Determine applicable exclusions;
  13. Calculate covered damages;
  14. Issue a decision; and
  15. Communicate the decision to the applicable parties.

Claims may take longer where:

  • Liability is disputed;
  • A third party is involved;
  • Police records are unavailable;
  • Damage requires an inspection;
  • Fraud is suspected;
  • Insurance coverage is disputed; or
  • Additional documentation is required.

88. CLAIMS PAYMENT

If a Covered Loss is approved, payment may be made:

  • Directly to a repair facility;
  • To a Host;
  • To a Guest;
  • To a third-party claimant;
  • To another authorized party; or
  • Through another method permitted by the applicable policy.

Payment does not necessarily constitute an admission of liability.

89. REPAIR AUTHORIZATION

Guests and Hosts should not authorize major repairs relating to a protection claim without approval from JoyRide or the applicable Protection Provider unless immediate repair is reasonably necessary to prevent additional damage or address an emergency.

Unauthorized repairs may affect the evaluation of a claim where permitted by law.

90. MITIGATION OF LOSS

Guests and Hosts must take reasonable steps to prevent additional loss.

Examples include:

  • Moving a disabled Vehicle to a safe location;
  • Locking the Vehicle;
  • Reporting theft;
  • Preventing additional water damage;
  • Avoiding continued operation of a seriously damaged Vehicle; and
  • Following reasonable safety instructions.

A person should never place themselves or another person in danger to prevent property damage.

91. ABANDONED VEHICLES

A Guest must not abandon a Vehicle.

If a Vehicle becomes disabled, the Guest must follow JoyRide's roadside-assistance and emergency procedures.

Unauthorized abandonment may result in charges and may affect protection.

92. IMPOUND AND STORAGE

Protection generally does not cover costs caused by:

  • Illegal parking;
  • Traffic violations;
  • Unauthorized use;
  • Driver misconduct;
  • Abandonment;
  • Failure to follow law; or
  • Other Guest-caused circumstances.

Where such costs are incurred because of a Covered Loss, the applicable policy will determine whether they are covered.

93. VEHICLE RECOVERY

JoyRide may use lawful means to recover a Vehicle where:

  • A Guest fails to return it;
  • The Vehicle is believed stolen;
  • A Trip is terminated;
  • The Guest violates the Terms;
  • Law enforcement requests assistance; or
  • Recovery is otherwise reasonably necessary.

Location information may be used where legally permitted.

94. COOPERATION WITH LAW ENFORCEMENT

JoyRide may cooperate with law enforcement concerning:

  • Theft;
  • Fraud;
  • Accidents;
  • Criminal activity;
  • Identity theft;
  • Vehicle damage;
  • Unauthorized use; and
  • Other matters.

JoyRide may disclose information where required or permitted by law.

95. PROTECTION TERMINATION FOR ACCOUNT VIOLATIONS

JoyRide may terminate or suspend a Protection Product where:

  • An account is suspended;
  • Identity verification fails;
  • Fraud is suspected;
  • The Guest is no longer eligible;
  • The Trip is cancelled;
  • The Vehicle is removed;
  • Insurance becomes unavailable;
  • Applicable law requires termination; or
  • Another permitted basis exists.

Termination does not eliminate rights that already accrued under applicable law or an applicable insurance policy.

96. PROTECTION TERMINATION DOES NOT ELIMINATE LIABILITY

Termination of protection does not automatically eliminate liability for conduct occurring before termination.

A Guest may remain responsible for:

  • Damage;
  • Theft;
  • Fraud;
  • Unauthorized use;
  • Fees;
  • Claims; or
  • Other legally recoverable amounts.

97. CHANGES TO PROTECTION PRODUCTS

JoyRide may change Protection Products for future Trips.

Changes may include:

  • Pricing;
  • Protection levels;
  • Available options;
  • Claims procedures;
  • Providers;
  • Eligibility requirements; or
  • Other terms.

A change will not retroactively reduce protection already provided where doing so is prohibited by applicable law or the applicable policy.

98. INSURANCE AVAILABILITY

Protection Products may not be available in every:

  • State;
  • Territory;
  • Vehicle type;
  • Trip type;
  • Driver category; or
  • Circumstance.

JoyRide may restrict or suspend protection where insurance becomes unavailable or where continuing to offer a Protection Product would violate law.

99. NO IMPLIED PROTECTION

No protection exists merely because:

  • A Vehicle is listed;
  • A Guest has an account;
  • A Guest pays a booking fee;
  • A Host lists a Vehicle; or
  • A Trip occurs.

Protection must be identified in the applicable booking or protection documentation.

100. INTERPRETATION

These Protection Terms should be interpreted consistently with:

  • Applicable law;
  • The applicable insurance policy;
  • The applicable certificate;
  • Applicable state-specific disclosures;
  • JoyRide's Terms of Service; and
  • The applicable booking confirmation.

If a provision is prohibited by applicable law, it will be modified only to the extent necessary to comply with that law.

101. GOVERNING LAW

Except where applicable law requires otherwise, these Protection Terms are governed by the laws applicable to the JoyRide agreement and the applicable Trip.

Mandatory insurance and consumer-protection laws of the jurisdiction where the Trip occurs will apply where required.

102. DISPUTE RESOLUTION

Disputes concerning a Protection Product may be subject to the dispute-resolution provisions contained in JoyRide's Terms of Service.

However, nothing in these Protection Terms eliminates:

  • Mandatory insurance regulatory procedures;
  • Mandatory claims procedures;
  • Statutory consumer rights;
  • Regulatory complaint rights;
  • Rights against an insurance carrier under applicable insurance law; or
  • Other rights that cannot legally be waived.

103. ARBITRATION AND INSURANCE CLAIMS

Where an insurance policy or applicable law provides a separate dispute-resolution mechanism, that mechanism may control insurance disputes.

The arbitration provisions contained in JoyRide's Terms of Service govern disputes between a user and JoyRide only to the extent legally enforceable and applicable.

They do not amend or replace an insurance policy.

104. SEVERABILITY

If any provision of these Protection Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

105. NO WAIVER

JoyRide's failure to enforce a provision does not constitute a waiver of that provision.

106. ENTIRE AGREEMENT

These Protection Terms, together with:

  • The JoyRide Terms of Service;
  • The applicable booking;
  • The applicable Protection Product disclosure;
  • The applicable insurance policy;
  • The applicable certificate;
  • Any applicable state-specific disclosure; and
  • Other documents expressly incorporated into the protection transaction

constitute the applicable agreement concerning the Protection Product.

107. ELECTRONIC ACCEPTANCE

Protection Products may be accepted electronically.

By selecting, purchasing, or accepting a Protection Product through JoyRide, the user agrees to these Protection Terms to the extent permitted by law.

Electronic records of acceptance may be maintained by JoyRide.

108. ELECTRONIC DELIVERY OF DOCUMENTS

JoyRide may provide:

  • Protection disclosures;
  • Certificates;
  • Policy information;
  • Claims information;
  • Receipts;
  • Notices; and
  • Other documents

electronically where permitted by law.

Users are responsible for maintaining access to documents relating to their Trips.

109. STATE-SPECIFIC SUPPLEMENTS

JoyRide may publish state-specific supplements to these Protection Terms.

If a state supplement conflicts with the general Protection Terms, the state supplement controls for Trips governed by that state supplement.

  4. Certificate of insurance;
  5. Specific Protection Product terms;

This hierarchy does not eliminate any rights or obligations that cannot legally be modified.

These Protection Terms describe JoyRide's Trip Protection / Platform Protection program.

Where JoyRide provides insurance, the applicable insurance policy and endorsements control insurance coverage.

Where JoyRide instead contractually assumes responsibility for certain physical damage, that protection agreement and applicable law control.
